Old Guy on Two Wheels reports that Stephen Gilbert, the drunk driver who killed Cody Johnson, was set to receive only a misdemeanor charge, but that there was a chance the charge would be upgraded to a felony.
If I'm reading the docket search correctly, it wasn't. Gilbert is set to appear on Jan. 7th for a charge of DWI, which as we know from the Bicycle Austin traffic laws page, is only a Class B misdemeanor, with a maximum fine of $2,000, or 180 days in jail, or both. Though as I always say, I'd like to see "lifetime revocation of driver license" as one of the possible sentences for someone who kills another road user.
May I point out, a drunk driver who doesn't actually hurt anyone would face the same Class B generic DWI charge. Gilbert actually killed someone, but he wasn't charged with something more serious (like Intoxication Manslaughter).
