Ah, but murder it could be*, both in this unfortunate incident and in your
hypothetical, which is something to keep in mind when you think it might be
just to pop someone because he was rude or what. Also, keep in mind that the
thin version of the facts in the AAS article leaves us with next to no idea of
what happened or why, but until more is known, why would police rule out an
obvious possibility?**
*there are degrees of murder, you know, but it really depends on what went on
and intent and the cause of death and available defenses and such things, but
none of them are a charge you want on your head either.
**like the police often will do with 'the truck ran me off the road'
(attempted murder or at least assault implied) cases, but that's a whole
'nuther gripe session.

If you sucker-punch an SOB who wants to kick your ass, who then turns out to
be diiabetic and later dies from an infection 4 months after you broke his
tooth in the fight, that's MURDER. (??)

Nobody in this confrontation had the right to use violence. But I still
don't think the charge of murder is warranted.
